What this covers
These terms cover this website and the MIZAN tools, both the paid engine and the free ones. Using the site or the tools means you accept them. They come from QWERTY Options Inc., a California company.
The software and how access works
The MIZAN engine and free tools run on TradingView. Paid access is sold through Whop, and the checkout terms shown there at the time of purchase govern billing, the trial, cancellation, and refunds. TradingView’s own terms govern the platform itself. Paid access is granted to one TradingView username and is not transferable or shareable.
One more thing about payment disputes, because we keep receipts: a chargeback filed while access was delivered and in use is a violation of these terms — access ends immediately and permanently, including future purchases, and every dispute is answered with the record: the access grant to your TradingView username, your acceptance of these terms at checkout, and the immediate-delivery acknowledgment. If something is actually wrong, email us first — it is faster than a chargeback, and a human answers.
Not advice
Everything here is educational software and content. Nothing on this site, in the software, or in the newsletter is financial, investment, tax, or trading advice, or a recommendation to buy or sell anything. We are not registered investment advisers, and using the tools creates no fiduciary relationship. The tools describe market conditions; the decisions, the sizing, and the risk are yours. MIZAN is analysis software — not a signal service, not a trading bot, and not an execution system.
No guarantees
The tools are provided as they are. No tool wins in all conditions, and we make no promise of performance, accuracy, or uninterrupted availability. Past behavior, on charts or in the on-chart tracker, does not indicate future results. Trading involves substantial risk of loss; never trade capital you cannot afford to lose.
Regulators wrote a specific paragraph for simulated and hypothetical results — the on-chart tracker and the site’s engine simulation are exactly that category — and paraphrasing it helps nobody, so here it is verbatim:
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
Fair use of the tools
The open-source tools are published on TradingView under its rules: read the code, test it, use it. The paid engine’s code is closed. Don’t resell, share, or attempt to extract, copy, republish, or reverse-engineer it, don’t build derivative or competing tools from it, and don’t use the site or tools for anything unlawful. We can revoke access that violates these terms — immediately and without notice — and access revoked for a violation is not refunded. The engine’s output — signals, alerts, and webhook payloads — is licensed for your personal use only; republishing or redistributing it, including through chat rooms, signal feeds, or bots, is not allowed. Some thinkorswim builds are sold as source code for a one-time fee; each sale licenses one buyer for personal use: run it, modify it for yourself, keep it forever, and do not resell, share, or republish it. Those sales run through Whop and its checkout terms.

The writing, charts, design, and name on this site belong to QWERTY Options Inc. MIZAN™ is a trademark of QWERTY Options Inc. Quote it with attribution; don’t republish it wholesale.
Liability
To the maximum extent the law allows, our total liability for anything arising from the site or the tools is limited to the fees you paid us in the twelve months before the claim. We are not liable for trading losses, lost profits, or indirect damages.
Disputes: talk first, then arbitration — individually
If something goes wrong, email us first — most problems are fixable in a day, and you agree to give us 30 days to try before formal proceedings. After that, any dispute arising from these terms or the tools will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, and the Federal Arbitration Act governs this section. Hearings may be conducted remotely or in the county where you live.
Class action waiver. Disputes are resolved individually: you and QWERTY Options Inc. each waive the right to participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims. Either party may instead bring an individual claim in small-claims court, and nothing here waives your right to seek public injunctive relief where California law preserves it. If 25 or more similar demands are filed by or with the same counsel, the parties agree to batch them into staged proceedings so filing fees track cases actually being heard.
Your opt-out. Arbitration should be a choice, not an ambush: you may opt out of this arbitration agreement entirely by emailing qasim@mizanquant.com within 30 days of first accepting these terms, with your name and TradingView username. Opting out does not affect any other part of these terms. If any part of this section other than the class action waiver is found unenforceable, the rest stands; if the class action waiver itself is found unenforceable, this entire section is void.
Changes
If these terms change, the effective date below changes with them, and continued use means acceptance. These terms are governed by the laws of the State of California.
